4-3-101: PERMIT REQUIRED:No person shall engage in, conduct, or carry on the business of motion picture productions or still photography on private or public property without a permit issued under the provisions of chapter 1, article 1 of this title. (1962 Code § 6-9.01 et seq.)
4-3-102: DEFINITIONS:
MOTION PICTURE PRODUCTIONS: Means and includes all activity attendant to staging or shooting commercial motion pictures, television shows or programs, and commercially prepared radio broadcasts.
STILL PHOTOGRAPHY: Means and includes all activity attendant to staging or shooting commercial still photographs. (1962 Code § 6-9.01 et seq.)
4-1-101: GENERAL:The council finds that certain types of businesses and activities require specific regulation in addition to the general code provisions. Prior to engaging in any type of business or activity which requires a permit, such person shall obtain a permit under the provisions of this article, and shall comply with the terms and conditions of the permit and such other provisions of this code as are applicable to such business or activity. 4-1-102: APPLICATIONS FOR PERMITS:
Applications for regulatory permits shall be filed with the city and shall comply with the following requirements unless otherwise provided for a specific permit:
A. Completion of an application on the form designated by the city, and signed by the applicant under penalty of perjury.
B. Applications shall be filed a minimum of thirty (30) days prior to the date requested for issuance of the permit.
C. Payment of the fee as prescribed by council.
D. Such other information as required by the city.
E. Renewal permit applications shall be filed a minimum of thirty (30) days prior to expiration of any existing permit.
F. Where the applicant is a corporation, association, partnership, or other legal entity, applicant shall mean each partner, officer, director, and each shareholder owning or controlling more than ten percent (10%) of such entity. (1988 Code)
4-1-105: CONDITIONS IMPOSED ON PERMIT:
A. Conditions may be imposed on the permit as are reasonably necessary to protect the peace and tranquillity of any residential area, mitigate traffic impacts, protect other uses in the area, or protect the public health, welfare and safety.
B. Any person issued a permit pursuant to this title shall comply with all conditions that are imposed as part of the permit pursuant to subsection A of this section. (Ord. 90-O-2088, eff. 2-8-1990)
4-1-106: TERMS OF PERMITS:
Regulatory permits issued pursuant to this article shall be effective for a period of one year from the date of issuance unless a different period is specified on the permit, or is designated for the type of permit governing the specific business or activity. A separate permit is required for each location at which the business or activity is conducted or operated. (1988 Code)
4-1-107: REVOCATION OR SUSPENSION OF PERMIT:
A permit issued under this article may be revoked or suspended for any of the following reasons:
A. A material false statement contained in the application; or
B. Failure to comply with federal, state or local laws and regulations; or
C. Failure to comply with any conditions imposed by the city on the issuance of the permit; or
D. Failure to operate the business or activity in accordance to such orders, rules and regulations as may be applicable; or
E. Conduct of the business or activity in a fraudulent or disorderly manner, or in a manner which endangers the public health, welfare or safety. (1988 Code)
4-1-201: IDENTIFICATION CARDS REQUIRED:
Certain types of business activities regulated by permit under this code require that any employee or agent thereof obtain an identification card. Prior to commencing employment or engaging in any of these designated businesses or activities, the person shall obtain an identification card issued by the police chief. (1988 Code)
4-1-202: REQUESTS FOR IDENTIFICATION CARDS:
Requests for identification cards shall be filed with the police department and shall comply with the following requirements:
A. Completion of an application form as designated by the police chief, and signed by the applicant under penalty of perjury;
B. Identification of applicant;
C. Photograph and fingerprints of the applicant; and
D. Payment of the application fee as prescribed by council. (1988 Code)

4-3-103: EXEMPTIONS:
The permit requirements of this article shall not be applicable to the following:
A. Reporters, photographers, or cameramen in the employ of a newspaper, news service, radio broadcasting station, or similar entity engaged in on the spot broadcasting of news events concerning those persons, scenes, or occurrences which are in the news and of general public interest.
B. Any motion picture, television, or radio broadcasting studio operating at its established or fixed place of business in the city. (1962 Code § 6-9.01 et seq.)
4-3-104: APPLICATIONS FOR PERMITS:
In addition to the application requirements of section 4-1-102 of this title, the application shall be accompanied by the written consent of all property owners and persons in possession of property which are affected by the activity regulated by this article as designated in the rules and regulations promulgated by the director of finance administration. (1962 Code § 6-9.01 et seq.)
PERMIT:
Issuance or denial of a permit shall be based on the criteria of section 4-1-103 of this title, excluding subsection A1 thereof; and with the additional criteria that the permit shall be denied where engaging in the activity will create a substantial risk of injury to persons or property. (1962 Code § 6-9.01 et seq.)
4-3-106: TERM OF PERMITS:
Fees for permits regulating motion picture productions and still photography shall be on a per diem basis as designated by council resolution, and the permit shall designate the specific effective dates of the permit. A change of dates may be granted by the city official granting the permit, upon a showing of good cause by the permittee. (1962 Code § 6-9.01 et seq.)
4-3-107: RESTRICTIONS AND PROHIBITIONS:
No person shall engage in any motion picture, radio, or television production or still photography activity which would constitute a hazard to public safety or interfere with or endanger the public peace or rights of residents to the quiet, peaceful, and unmolested enjoyment of their property. (1962 Code § 6-9.01 et seq.)
4-3-108: RULES AND REGULATIONS:
The director of finance administration is hereby authorized and directed to promulgate rules and regulations, subject to approval by resolution of the council, governing the activity regulated by this article. All permittees under this article shall comply with such rules and regulations. (1962 Code § 6-9.01 et seq.)
